Through ZINAPAH, compensation is provided in cases where damage to the life or health of servicemen occurs while:

• participating in combat operations in defense of the Homeland,

• performing combat duty on the line of contact with the adversary,

• carrying out a special mission, or

• as a result of hostile actions by the adversary.

Compensation is provided to the following beneficiaries:

• In the event of a serviceman being killed or declared missing in action – the immediate family members, including:
  father, mother, registered or unregistered spouse (wife or husband), and children;

• Servicemen with 1st or 2nd group disability or with severe or profound functional limitations.

To be recognized as a ZINAPAH beneficiary, the following must be submitted to the relevant state authority:

• An application in the prescribed form (completed on site);

• A certificate recognizing the serviceman as having a disability and the decision of the competent state authority’s Central Military Medical Commission on the causal link between the injury/impairment and service;

• A certificate issued by the competent state authority conducting medical and social assessment confirming the causal link of death, stating that the serviceman died as a result of injuries or impairments sustained during combat operations;

• A court decision declaring the serviceman missing in action;

• Passports (or ID cards) of the disabled serviceman or the persons recognized as beneficiaries under the law;

• Other documents confirming eligibility as a beneficiary under the law, including marriage (or divorce) certificates, birth or death certificates, court decisions, certificates, etc.

The application must be signed by the beneficiary personally or by the beneficiary’s authorized representative, if a power of attorney is provided.

The list of documents required to be recognized as a beneficiary is defined by:

Decision No. 86-N of the Government of the Republic of Armenia dated February 2, 2017

A serviceman with a Group 1 or Group 2 disability or with severe or profound functional limitations, as well as a family member of a fallen or missing serviceman, applies to be recognized as a ZINAPAH beneficiary to the relevant state authority where the serviceman served, namely:

• Ministry of Defense of the Republic of Armenia

• National Security Service of the Republic of Armenia

• Ministry of Internal Affairs of the Republic of Armenia

The relevant state authority determines the circle of beneficiaries, the amounts payable, and submits the application package to ZINAPAH for payment within one month.

ZINAPAH reviews the submitted application packages for any deficiencies and/or inaccuracies within three working days.
If any issues are identified, ZINAPAH informs the relevant state authority so that corrections can be made.

If the application package is complete and without deficiencies, ZINAPAH opens special bank accounts in the names of the beneficiaries with partner banks and transfers the lump-sum payment as well as the first monthly compensation payment to those accounts.

When, as a result of injuries sustained during combat operations, a serviceman is unable to submit the required application due to mental or psychological incapacity, the application for receiving compensation is submitted by the serviceman’s family members, and the compensation is paid to the family members in accordance with the procedure established for fallen servicemen.

In accordance with the applicable legal regulations, a child born after a serviceman’s death may also become a beneficiary, provided that the child’s descent from the fallen serviceman is confirmed in the manner prescribed by law.

In such cases, documents confirming paternity must be submitted (a court decision, a certificate of paternity determination, a birth certificate, or another relevant document).

The amount of the one-time lump-sum payment and the monthly equal payment payable to each beneficiary is determined by dividing the respective total lump-sum compensation and monthly compensation amounts by the number of beneficiaries.

In the case of families with three or more children (minor children or children up to 23 years of age who are students), the additional payment is paid exclusively to the children who are entitled to it.

Accordingly, the amount of the additional payment payable to each eligible child (minor or student child up to 23 years of age) is determined by dividing the additional amount (AMD 100,000) by the total number of eligible children.

From the total compensation amount, a one-time lump-sum payment is made as follows:

• AMD 10 million to the family members of fallen and missing servicemen;

• AMD 10 million to servicemen with Group 1 disability or profound functional limitations;

• AMD 5 million to servicemen with Group 2 disability or severe functional limitations.

The remaining balance of the entitled amount is paid in equal monthly installments over a period of 20 years to the special bank accounts opened by ZINAPAH.

The amount of the one-time lump-sum payment and the monthly compensation payable to each beneficiary is determined by dividing the total lump-sum amount and the total monthly amount equally among all beneficiaries.

In the case of families with three or more children (minor children or children up to 23 years of age who are students), the additional amount of AMD 100,000 is paid exclusively to the children who are entitled to it.

Accordingly, the amount of the additional payment payable to each child is determined by dividing the additional amount equally among all eligible children.

Compensation payments are made directly to the beneficiary or, with the beneficiary’s consent, through another beneficiary.

Payments due to a minor or legally incapacitated beneficiary are made through their legal representative (parent, adoptive parent, guardian, or custodian), or, with the consent of the legal representative, through another beneficiary.

The lump-sum payment, as well as the first monthly installment, is transferred by ZINAPAH to the beneficiary’s (or legal representative’s) special bank account within three working days following the session at which beneficiary status is granted.
Subsequent monthly equal payments are transferred to the beneficiary’s (or legal representative’s) special bank account on the 10th of each month, in accordance with ZINAPAH’s payment schedule.

A beneficiary has the right to apply to ZINAPAH at any time to have their share of the compensation paid directly to them personally.

In the case of a minor or legally incapacitated beneficiary, such an application is submitted by the legal representative. The application may be submitted to the relevant state authority where the serviceman served or directly to ZINAPAH. In such cases, compensation will be paid in accordance with the new application starting from the month following the month in which the application is submitted to ZINAPAH.

In the event of the death of a beneficiary who is a serviceman with Group 1 or Group 2 disability or with severe or profound functional limitations acquired as a result of combat operations, the serviceman’s right to receive compensation does not form part of the estate and terminates.

In the event of the death of a beneficiary who is a family member of a fallen or missing serviceman, the compensation amount payable to that person does not form part of the estate. The payable amount is distributed equally (reallocated) among the remaining beneficiaries.

ZINAPAH receives information about beneficiaries’ deaths automatically from the Civil Registry authorities. Therefore, there is no need to submit the beneficiary’s death certificate to ZINAPAH.

Compensation payments are made exclusively through special bank accounts opened in the name of the beneficiary or their legal representative at ZINAPAH’s partner banks.

The key feature of these special bank accounts is that the funds credited to them cannot be pledged, frozen, seized, enforced, or offset against the client’s liabilities.

This means that no authority or organization may in any way restrict the beneficiary’s access to the compensation funds.

The mandatory stamp payment is a compulsory payment transferred to the state budget by every person working in Armenia.

According to the scale below, employees, individual entrepreneurs, and notaries pay the stamp payment depending on the level of their income.

For each reporting period:

1. Individuals who are not individual entrepreneurs or notaries and who receive income from a tax agent or from a person exempt from the obligation of acting as a tax agent (under contracts concluded and certified on behalf of the Republic of Armenia) pay the stamp payment at the following rates:

 The mandatory stamp payment is collected to compensate for damage caused to the life and health of servicemen.

Mandatory stamp payments must be transferred to the “Stamp Payments” account No. 900005001186, opened by the Ministry of Finance at the Central Treasury.

In the “Recipient” field, please indicate the State Revenue Committee, and

in the “Purpose” field, specify: Servicemen Insurance Foundation.

You may request a refund of the stamp payments paid during the previous year if your parent, spouse, and/or child:

• is performing compulsory fixed-term military service, or

• is a fallen (deceased) serviceman.

STAMP PAYMENT REFUND

No, submitting a report is not required when paying the stamp payment.

For individual entrepreneurs (IEs) and notaries, the reporting period is the calendar year, not the month.

Individual entrepreneurs who did not receive any income during the reporting year are exempt from paying the stamp payment.

Individual entrepreneurs, notaries, as well as individual entrepreneurs and non-notary individuals receiving income from persons who are not tax agents, make the stamp payment according to the following rates:

If an individual entrepreneur fails to fulfill the full obligation prescribed by law, the tax authority, in accordance with the law, adopts a decision to collect the unpaid stamp payment from the payer and duly notifies the stamp payment payer (or the tax agent).

Until the decision on collection becomes final and non-appealable, the tax authority may impose a seizure or apply restrictions on the property of the liable person in the cases and in the manner prescribed by the Tax Code of the Republic of Armenia.

Individuals whose salary does not exceed the monthly minimum wage established by the Law of the Republic of Armenia on the Minimum Monthly Wage are exempt from paying the stamp payment. In such cases, the employer makes the payment on their behalf.

The same Law also defines the minimum hourly wage applicable to hourly-paid employees.

If an hourly-paid employee receives more than the minimum amount per hour, the stamp payment is paid by the employee personally, regardless of the total amount actually earned during the month.

If the hourly rate does not exceed the minimum, the stamp payment is made by the employer.

Yes, members of servicemen’s families are also required to pay the stamp payment; however, they may apply for a refund in accordance with the procedure prescribed by law.
